Accident at Kerinci

nope, still no, he said the sprint driver went back to his 'kampung', but i thought these are the things that need to be settle first....


Can someone tell me what will happen to a driver if he involved in an car accident(like mine) but he didnt launched any report in 24 hours?

OK, Updates!

I messaged the Sarjan and ask for "perkembangan" and straight away he replied, "saya nak jumpa kamu 8malam hari ini"

* Someone told me that i shouldnt have inform him and just let the case be after some dispute, read below*

Went to see him, and after some discussion DANG, i started to kena.

He said the Sprint driver said he did on the Hazard Light(he didnt actually).

Then they said why do i want to cut to into the right lane... and they used this point to tekan me. Oh they ask me whats my speed, and i accidentally said 60-70... Limit is 50kmph. Dang! One more point i lose.

But i mentioned that the SPRINT Highway driver Contributed the accident because he didnt put the Kons....

He asked me, "if there's an accident at the front, you wished that people will help you right, the SPRINT driver is just trying to help out". But i mentioned that the driver should put the kon or on the hazard light first from the scene-30 meters away. Else what is the law for?

He didnt listen to me, and said "nevermind if cannot settle then go court(majistret i think he is refering).

He took out the Saman-Book, and intended to saman me. I said then i am losing, and i ask again, will the SPRINT claim their insurance on me? He said he got no guarentee because they are a privtate company.

Then i said again, " encik, sebenarnya kamu harus bantu saya kerana saya cuma 21++ tahun dan bukan bantu private company untuk kena-kan saya." Only i saw he soften down a bit.

So i said, then you shouldnt saman me, if you want, they both sides should have come and only if you intedned to do so, they only you summom me. Ok, at least i showed that i am not stupid till the end, he kept the booklet and call the other party to meet on this comming Sunday!

DAMN.


Anyway, i call my aunty (doing insuance one) and a lawyer to go with me this sunday(hope both of them can make it) then settle the problem ASAP.


Questions:
1: How long does it take to go to the majistret and go "through" the whole thing?

2: Will they delay the day to meet in Majistret? Or it is depends on what?

3: It is not all my fault right? They 'Contributed"?

1: usually wouldn't go to court unless it's very serious. Will usually settle outside; but don't know bout this as it involves a company

2: bro, will only meet in police station and the sarjan as the witness

3: unless there's a witness, everyone is correct. But anyway, you should debate the case again when you meet up with SPRINT's officer

3: Do you mean meeting him up personally? Outside the police station before going into the office.

Anyway, worst come to worst, he claimed my insurance, and i pay the saman. However, i will say that he 'contribute' to the accident because he is not the only one driver thats on the scene but with a couple. So either one could just set up the kon in advanced!

Or, maybe Civil Lawsuit and 'Negligence' will come into place, as a professional driver/officer for SPRINT Highway, he should have do all the 'necessary' step to prevent this accident.

Seems like the sprint guy may be "helping" the sargeant decide on the outcome of his investigation. It is possible that something like this could happen.

Since you've a lawyer at hand, can indicate to Sprint that you may take measures to sue them. After all, that is a very dangerous corner (remember the flipped "Evo") and they did no take the precautionary measures to inform oncoming vehicles that there is road maintenance going on (such as signboards and cones VISIBLY 30m away, not some hazard light around a blind corner). Worse come to worse, take it to the press.

Large companies normally try to avoid this by out-of-court settlement, since it also damages PR. BTW, any CCTV cameras at the scene? Can be used as evidence too.

What happened to the Flipped EVO? Lawsuit case? Any final decision, or any links on that? Do you know which road was that?

The police kept on stressign" Why do i want to cu into the lane while you are on the left? If u can explain this to me then this is not your fault..." Man, how to answer that? I said because at the front there got construction side(on the left side) so i try 'makan' to the left?

Damn, i think he saw... oh, a young and inexperienced guy then can bully. BUt in the end, he saw that i said' Encik, ini bukan salah saya, kalau kamu nak bagi saman, kamu harus panggil pihak yang lain untuk sembang sama sama...
