On this Groupon thing. I did buy a few things also, but please read the fine prints. So far, delivery is not a problem, but got one deal for food from a restaurant. Normally a meal will cost my family of 4, say somewhere around RM70, so when this deal was on it cost around RM40, so we bought it. But when we went to the restaurant, drinks, rice and appetizer were not included. In the end we paid another RM30 for them, therefore the meal came back to RM70.
Nowadays, we read carefully, like drinks, service & govt. tax and so on whether included or not.
Another is those 50% off vouchers. You buy many, thinking of enjoying more food, but the fine print mentioned one voucher per receipt, so you cannot use more then one voucher.....:banghead:

Yup, got the refund the same day when the vendor delivered the mop. Asked her to repay & told her off as to be careful when buying things from Groupon. Don't really like the idea of pay now & get your stuff over a month down the road.

I have a online fraud case back in 2010 and seller keep on postponing the refund(first promise want to settle then go silent then say want to refund again when I kacau his sales thread) up until today. I just pisses me off to the extent that it was not because of the money, I'm pissed off because of the sellers irresponsible attitude.

Maybe you can tell seller if he does not settle you will report to the tribunal, then see what he does.
But for tribunal case, you need to compile your receipts, documents etc....

just got back my power bank last fri, it was a new model but still same 5200MAH.
the manager was not there when i collected it, his staff passed it to me & went off.

still awaiting samsung to reply.

5200MAH CAN CHARGE 10 times? No wonder, I thought yours was the same as mine 11,200MAH...

Mine can charge about 8 - 10 times la...5200MAH can charge 10 times totally telling a lie...

There's no time stamp on complaints. As long as you have transaction details, receipts or/and invoices you're safe.

My case was with a cellphone line provider. About 6 years ago I was informed I was blacklisted by company "C" because I had outstanding bills. I went to their office and was shown 2 bills, one of which I recognised as mine as I paid. The other one I wasn't too sure so I asked for a bill listing. Since mine was an old case they said they'll get back to me later and gave me a case number.

I completely forgot about it until 2 years later then I called them up to ask what happened, another ticket was logged and no action taken.

This year I wanted to subscribe broadband services and was told I was still blacklisted. Wrote to company "C" to inquire how to settle this? They informed that I had to pay the outstanding RM800+ bill to clear the blacklist. I countered that I had asked for details or the last outstanding bill printout 6 years ago and did a followup 2 years later with no results. They shot back at me saying that bills older than 7 years weren't retrievable so nothing could be done about my request.

I fired back and told them that it was their problem not mine. I asked for the details 6 years ago, if back then they had given me what I wanted (I had a ticket number) then this wouldn't have dragged past the stipulated time. I needed to verify that the bill was indeed mine and not blindly pay RM800+ just because you said so.

They kept on insisting that nothing could be done about the bill and I had to pay. So I just send them an ultimatum : Either you do something about this outstanding bill and blacklisting or I'll bring it up with the consumer tribunal.

Followup letter showed me that the account manager had discussed with his boss and that boss asked to waive the whole amount and to clear the blacklisting.

Case settled. Now I'm on broadband. :biggrin:


Moral of the story : If you have a genuine case and can back your claims up with proof, go to the tribunal or threaten to go tribunal. Usually this will get things moving much faster.
 
SF, he told me 5200 mah can charge 3.5 times, but actual 2 times only.

So usually I just charge overnight then can charge about 2 times la, :rofl:

Is a powerbank so just have to charge it full...Even Nissan Leaf is now a powerbank :rofl:
 
I was thinking out loud. What if - let's say we bought something from a car accessory shop. Installed it on our ride - knowing 'vaguely' that it's pushing the boundaries of our JPJ laws but the shop owner or any of his staff has never cautioned you nor any disclaimer was written in the receipt. ..... one day, your ride gets flagged by the authorities and u get a ticket for illegal modification or what not.

Can you go sue the business owners for:

1. Putting you through an ordeal with the authority
2. Compensation on wasted time : installation of product, time wasted during 'ticketing' session', etc.
3. Negligent - the seller failed to inform you that the product is not legal and the seller itself failed to sell items that is compliance with the law.
4. Psychological scarring - everytime you see a cop, u piss in your pants, u feel like taking a cab for the rest of your life (the seller bears the cost)
5. Others.


This would make all the sellers be more cautious of what they are selling.... but this will also mean an economic disaster as 90% of the shops in Sunway would tutup kedai... whahahahaha
 
egal Issue on Contract Law in Malaysia - Good for us to know

This is something I like to share with you from one of my seminars recently. If you find this informative, please circulate. It was conducted by Associate Professor Catherine Tay on Legal issues in E-commerce.

Notice that most of the time, the receipt / invoice you received from the merchant carries this exclusion clause or similarly worded statement: 'Goods sold are not returnable' or 'No refund once sold'.

The thing that I have learnt from her is that : 'As long as your good is purchased for home use and not for business ( i.e. to be resold), the above exclusion clause is VOID.

That means, as long as the good is defective, regardless of what is worded, you CAN get back all your money spent. You do not have to accept a repair on the good or an exchange. You CAN ask for a refund. AND you are LEGALLY right and entitled to! What a relevation!!

And most of the time the merchant will refuse to return you your money.

Her advice? >From her own experience ( and no less than 7 and all successful!) , she will threaten the merchant with four words: 'SEE YOU IN COURT!'

The court here refers to the Small Claims Tribunal Court.

However, you don't have to tell them what court! All you have to pay is RM10 admin fee and the loser (the merchant) will have to refund you the money PLUS the admin fee!
She shared this with us because she felt that even educated people are cowed by such unfair wordings (which includes her jaded friends who are not lawyers).

Please try not to let the merchant fleece you the next time you have a defective good.

I know where to file this. On the 16th floor of Putra Place (The Mall opposite Putra World Trade Centre) . The form costs RM5.00. The Tribunal will settle the case within 2 months' period.

I was thinking out loud. What if - let's say we bought something from a car accessory shop. Installed it on our ride - knowing 'vaguely' that it's pushing the boundaries of our JPJ laws but the shop owner or any of his staff has never cautioned you nor any disclaimer was written in the receipt. ..... one day, your ride gets flagged by the authorities and u get a ticket for illegal modification or what not.

Can you go sue the business owners for:

1. Putting you through an ordeal with the authority
2. Compensation on wasted time : installation of product, time wasted during 'ticketing' session', etc.
3. Negligent - the seller failed to inform you that the product is not legal and the seller itself failed to sell items that is compliance with the law.
4. Psychological scarring - everytime you see a cop, u piss in your pants, u feel like taking a cab for the rest of your life (the seller bears the cost)
5. Others.


This would make all the sellers be more cautious of what they are selling.... but this will also mean an economic disaster as 90% of the shops in Sunway would tutup kedai... whahahahaha

I don't think this is a case for the tribunal. It's more like a full on negligence lawsuit.

If I were you, I would. But best to discuss with the parties involved first to see how to progress. Sometimes if gentleman enough they will respond without the need of tribunal.
 
Hi guys, I need advice from all of you. I am filing a claim againt a kitchen cabinet contractor KS Kabinet Dapur.
The hearing will be on 26/2/2013. What should I prepare for the hearing?
