ok. u tell the tribunal president bout your story. btw, are there any legal document stated that when will the
project start & end?, if no nvm......how many % is he onto the job? not even halfway?

anyways, the president will either get him to complete the job within a timeframe. Or worst case scenario refund your money minus
the raw materials he has bought for your renovation.

have u passed him his copy of the tribunal form? did u try to slow talk for him? all bussiness hates tribunal btw...haha....mention to him that this tribunal case will have great effect on his bussiness & dont expect it to go well after that.

why? cos u will spread the news all over town, in forums, blogs, fb, twitter etc.......
maybe if u have time u could write to the press.....tell him in a nice way dont ever threaten him, it will not look good for you.

if still dowan to settle outside, then just proceed for tribunal, remember while waiting for you trial, u are able to cancel your hearing if he suddenly calls u out of the blue to settle outside.

some complicated cases can drag until 2 years......so hope your case is not 1 of it....

when u enter the hearing hall, if your case is the 1st then cialat lo for 1st timer......everyone will hear your case....if yours is the middle or towards the end then good la....can hear other ppl's case..quite interesting also.

just act innocent, tribunal is to protect consumers not the other party.

also dont take it for granted...prepare your bullets, u might not know wat he will say......always anticipate his thoughts....

for me no need lawyer....all thru experience haha......i went to mahkamah syariah rendah also no need lawyer...
the other party did get some advice from his lawyer but not me...i still manage to defend myself....

can i go to hearing hall to listen to other people case? i have nothing to do with the case ..but i want to be busybody listen and learn,.. can it? do i have to pay? how to go there?.. can drop by there on weekend when i free..

as for my case, actually I'm not the only victim to the contractor. There is few others, and some had been con for 10k++.

I won the case, he already paid partial amount. He still owe me RM2k. He kept promise to pay the balance. But it has been months of promised. I give him until this sunday. If nothing happened, I will continue to next step.
1- report this case to tribunal
2- report this case to police department (due to melanggar perintah mahkamah)
3- post this case online and and let whole world know about it.

hi,

just wanna share my journey in the tribunal..

i bought a car, 1 month back. at the point of purchase, was ensured that the car was free from accidents etc.
until we went to malacca for a road trip but the car beginning to feel shakey and unstable.
went back and consult a workshop, was told that the car got an accident as the undercarriage had a huge crack. bonnet crack too.
so we went to the dealer and complained, left the car for 2 weeks and was told that all things were repaired..
went back to consult workshop again, it didn't... all they did was to spray black paint on it which your kids probably could do it too.

pissed off and feel cheated again and again.
hence decided to take things on my own, repair cost around rm 3k - 4k.

today, i called up the salesman as he said will settle the bill but after hearing the amount, he mentioned that he's not liable and will call me back when possible. waited for the whole day but he didn't.

hence, we went to make a police report and shared the above story.
we intend to file a claim in tribunal.

as owner of car is my wife, while myself already became singapore.. she's always had poor views on malaysia governing bodies..
we also fear that our car or ourselves could be targeted by the dealer..
we really hesitated.. but this is too much for me to swallow.. i don't like to be cheated, repeatedly.

my only concern is that during the purchase of the car, we did sign on their terms and conditions.
and even mention that car is inspected by pupaskomp..

will this be a disadvantage to me?

i doubt even the pupaskomp can see it as it is hidden by the wheels.. once removed the wheels, you will see a huge crack underneath.
i already took all the necessary pictures of the cracks and damaged parts resulted from the accident

as of now, i'm preparing my homework; taking photos and printing them out.

Police report made, sending car to workshop then to panel beating.
this estimated to be around 1-2weeks of time.

to further substance my case, i also logging a report at https://psiiss.net/contact.php as it violate and endanger my family and myself in terms of safety.

Dear Sir/Madam,

First of all I would like to thanks for ask this question to the Consumer Claims Tribunal (TTPM). From what the you specify, complaints you relate to section 32 of the Act deals with the protection of the users of this guarantee implied about the appropriateness of an acceptable quality (1) where goods are supplied to the user, there shall be implied a guarantee that the goods it is of acceptable quality, in this case the matter in dispute is the quality of the goods and the Representation is false or misleading.

2. If you wish to file a claim, first you must be get proof of black and white/quotation from another workshop to evaluate and ensure the actual cause of damage to the car and also the total cost to repair the car. If you have the evidence, then you can file a claim using form 1 can be obtained at the TTPM Office at Level 17, Menara Ansar, Jalan Trus, 80000 Johor Bahru, Johor or you can download the form on our website and send by post or you can make filing online via our portal at the address http://ttpm.kpdnkk.gov.my.

3. It is emphasized that the decision on a claim is filed will be made based on the facts and law submitted/referred to by both parties during trial claim. The jurisdiction of this tribunal is to hear and determine claims filed through the form 1 by the user. If you have any questions, please contact the TTPM immediately for further clarification of the claim you.

Just give a call to TTPM.. easier to clarify than to ding-dong in emails. I just filed Tribunal as well as I bought a RM2k+ smartphone and it is faulty even after "repair". I don't want to waste my time ding-dong with their "service" so just file tribunal.

HTC? My friend bought HTC One X for less than 5 months, screen kaput. Changed twice.
