The verdict has been finally delivered on the naming dispute between Group Lotus and Team Lotus with the judgement favouring Group Lotus although Team Lotus can continue to use its current name in the Formula One championship.

A summary of the judgement clarifies that Group Lotus has the right to use the name ‘Lotus’ on its own within Formula One. Team Lotus on the other hand, though allowed to continue to use its current name, will not be allowed to use the ‘Lotus’ moniker on its own. Group Lotus will also be entitled to continue racing in its historic black and gold race livery.

The 1Malaysia Racing Team (1MRT) was ruled to have breached the terms of the licensed agreement and as such will pay damages to Group Lotus. Furthermore, the Team Lotus Ventures trademarks were revoked from them for non-use of it.

In a nutshell, Group Lotus’ current trademarks remain unaffected and they can continue to use the ‘Lotus’ names on their road cars.

Regarding the decision to allow Team Lotus to continue racing in Formula One under the name, Group Lotus has expressed concern that the jedgement will cause confusion for the spectators. Group Lotus will be making an appeal on that so that the issue will be clarified once and for all.
