I'm a buyer

would like to report 8170 (apexi safc post)

for stealing my deposit money

additional facts :-

Chronological events

1. Met buyer to examine his product. Did not really had a chance to test it as my car is still in the workshop. Still, I paid a RM20 booking fee for it on condition that I get it installed properly in my car and test it before paying the balance payment. At this point, it must be noted that the deposit was not stated whether it is refundable or non-refundable. (At the absense of an exclusion clause - this means it is still refundable under contract law - meaning, the money is held under trust but still belongs to the original buyer)

2. Few days later, he said he can't sell the safc to me as his current one was damaged. Since I had no choice to the matter, reluctantly said ok. He said he would refund.

3. Another day or two, he informed me again to say that he found a replacement unit and he can now sell the safc. However, as my car is still in the workshop, I said ok & will confirm taking once the car is ready.

4. However, my wiring problem took longer than expected & told him to sell it off first since he could get his money faster rather than waiting for me. Also, during the time of his 1st cancellation I had already booked another safc since I was told he could not sell it to me.

5. Once I saw his post that he sold off the safc, I asked for my money back. AFter all, the sale transaction did not complete and there was no exclusion clause as to non refundable deposit. I have a right to my money. The seller disagreed & said the deposit is forfeited.

Conclusion - I felt 8710 cheated my money both unethically & illegally. Taking someone's elses money tantamounts to theft.

Course of action - Since the seller does not want to return my money, the only thing I can do now is :-

1. report his actions to the forum so whenever anyone deals with him in the future, pls take note.
2. report to police - since I have his details and car no. I will proceed to make a police report for theft. Although it is only RM20, it doesn't give a person a right to steal. I hope a maximum sentence of 5 years inprisonment will be worth my RM20.

Advise - next time for any sellers/buyers pls make sure there is a written proof whenever money/product has been transacted to avoid things like this happening. If u feel that u have been cheated, make sure you report it not only to this forum but also to the proper authorities so that others will not suffer the same fate.

ok...here's your side of the story. Interested parties can refer 'For SALE & ADS' under 'Engine and Performance' topic...'ZTHians...Pls be judges...read last posting' for my side of the story... If u guys feel I that I'm in the wrong, I'll gladly return the money back to him... But pls hav a look to be fair!
Thanks!

Actually, some people do not have good etiquettes when it comes to selling or buying something.

Here is my experiences with such people.

Case 1.
- Some dude posted a used Sparco Sprint for sale at RM500
- Immediately I called him to confirm my purchase during which I was in JB. We verbally confirm the deal at RM500
- Upon returning from JB, I rang him up again to reconfirm my decision and I even told him I'd personally take out the Sprint and install his Ori seat back for free.
- Finally we meet and SUPRISE SUPRISE, he demanded me to pay additional RM50. Why? the reason is someone has just offered to buy the seat for RM550.

The morale of the story : Please honor wat you commit. Although, I paid you the RM50, but deep down in my mind I have a bad impression of you and your words.

Case 2.
- Someone posted a APEXi Ball pen TT for sale at RM200.
- I called him to confirm. We verbally agreed the deal at RM200 and to meet up later in the evening on that very day.
- Later tat day, while having dinner, I called the seller to inform him roughly about what time I will reach his house.
- To my frustration, the seller said he oledi sold it to someone else because the other party offered to uninstall the APEXI TT free of charge.

Case 3.
- Someone PMed me to buy 2 pcs of the Oil catch tank.
- I told him OK. I will install it for free.
- Later, to my suprise, the buyer posted on another thread and confirmed to buy oil catch tank from another seller. So I though OK lor.
- Then he changes his mind and decides to buy from me. Not 2 pcs but only 1 pc.
- He insisted me to give him a lower price to offset the installation because he does not want installation anymore.
- He accuses me of being a cheat and liar for not giving him the lower price.
- I told him. I gave him an offer and since he decided to purchase it from another source, then it automatically revokes any offer made by me earlier. If he decides to buy from me again, it then becomes my prerogative whether to offer him the price offered earlier or not.

Can we have sumkind of feedback ratings on sellers and buyers? So if we post sumthing for sale.. and if it turns sour we can leave a bad remark on his nick. Or if he is a good recommended seller or buyer.. a good remark can be placed instead. Posting should be deleted over a certain period... it's flooded with sold items..

I'm not here to report lousy seller.. but to report a good honest seller. E39a sold me the transparent timing belt cover. Exactly like what he posted. :)

I am not sure if the guy hangs around here. He was into cars and forums, some of you should know him. He hangs out at teh tariks too, subang and everywhere else.
But this dude's name is Azrai, can't recall last names. Owned a GTi and was active in the GTi club at one time. Ran a rally few yrs back, bought a roll cage from me but owes me the money till today. It's been years.
His GTi was stolen and he was driving a 200SX from singapore (automatic) which he claims he is bringing in to sell. Anyway, he changes number often and even his mom and dad has disowned him. I had his home number, and his mom says this son is a disappointment and the family does not want to be involved in his dealings.
Smooth talker, seems decent but broke like hell.
I am not trying to be petty about the RM800 roll cage I sold to him, but I sold it to him in good faith so he could take part in the rally.

WK will be the last person i'd ever introduce to go purchase items from you
I think his case was not handled very professionally nor fairly.

The item bought from u, were given:

1> warranty upon items not in good condition
2> refund upon non-compatibility, or defect.

I asked u to recommend a place that's affiliated to Millenium for the installation
of the item, u were like, slacking abit... going in circles saying couple of work
shop names and all. The reason i asked u to recommend is bcoz the product is
sold by u, u should ensure that someone u know or trust will install it, therefore
the warranty stays as it is.

Moreover, he offered to pay more for the wideband tuning to ensure that everything
is running fine instead of being too rich / lean or etc. This is also a good way of
proving to him how responsible, how skilled your tuning is and therefore, securing
another customer under your wings.... but....... again.. your reverts were given
in circles... "tak pa brother! dun worry.. install first!.. can kau tim... ok..." nevertheless,
u told him to wait for your call the next morning, u'll kautim for him.. he waited
the whole morning, he even called u.. but u didnt pick up his call...

So, all these dilly-dallying, ding-donging for weeks and months..it lead to WK
going to another workshop to install the turbine. Only to find that the turbine fin
is crooked and slightly twisted. Moreover, the fin is smaller than even a TD05
and similiar to TD04.

Ok, so upon inquiring, u say u'll get back to him, calling your friend / sources
and all for clarification...again, weeks & many moons passed..so finally, we went
up to yer place with the turbine, u called your fren again, and u asked dear WK
to return again tomorrow for the setup appoinment, which was, eventually dunno
lesap to where.

So, again, weeks and many moons passed finally, he got hold of u, and requested
for a refund... which was reverted with the motion to 'exchange items' inreturn for
the refund. I find this acceptable as most of the items purchased is not refundable
eventhough you've given the above 2 criterias before purchase.

We are fair and understanding pple.

To my surprise, he was given this 2 stage boost controller at the price of 1K instead
of what was posted here with the reason being, THE PRICE POSTED IS THE MODAL
TO BELI THE BOOST CONTROLLER and you rugi alot on this deal and etc.

I know it's non of my business as this dealing is done between the 2 of u.. but
i was the introducer of this customer and i was there when this dealing first
went through.... this would not affect our friendship but it will end my good will
to intro potential customers to u... i can clearly differentiate this two actions...

I don't know wat's all this hassle and all.. i need not any further discussion,
explanation nor arguments. All i can say is, this is the end of any introduction of
any potential customers to you from me. I paid off the levy of watever that exist
from this deal. I can afford to pay for it as i value my friendship with wk and
i have to bear the responsibility for this...

Conclusion:

1> Item bought
2> Item found to be defective
3> Item to be refunded.
4> Item was exchanged for an item no.2 priced at a higher price to be equivalent
to the item no.1 eventhough it's published to be at a price much lower than that
offered during the exchange.

p.s even my calls to you for the purchase of the wastegates were not picked up, but
the funny thing is, vestax can get through to you .. even him, a person not working
for millenium got back to me on the info about the wastegates while u didnt.. i called
you at least 20x.. but not 1 single return call to follow up on this... so i bought it
elsewhere...

Josh, i bid u good luck in your future undertakings with such methods in conducting
your businesses.

Rgds,

Rgds,
well well well u guys love having fun by simply buying something and not wanting it when the item is not even defected or anything like that.

no1 as said the item will be on waratee on not good goods..
many people have seen the item and event he shops who make turbos in KL have already check it many times that it is 100% in perfect condition.

Mr BlackHowling..U dare tell me that the it has croked fins etc..etc...wow i love your guts man. When i asked WK he says first..the fin rosak..i said show me then he says noo la actually the its okay but i just dont want it because its not big enough.

Damn what an excuse.. The item is in mint conditon and is runing perfectly. How?

nevermind since we are all friends I told him okay u take a dual stage boost controller which is worth RM880 which is not far from what he bought the thing.
U make it sound that i never bothered taking the part back. And i also mentioned to him that if i could source something of your dream kinda liking turbo i will let him know and u can return me the stuff and u pay the diff for the turbo.go ask him mr Blackie..

so please please watch what u guys simple talk.
