additional facts :-

Chronological events

1. Met buyer to examine his product. Did not really had a chance to test it as my car is still in the workshop. Still, I paid a RM20 booking fee for it on condition that I get it installed properly in my car and test it before paying the balance payment. At this point, it must be noted that the deposit was not stated whether it is refundable or non-refundable. (At the absense of an exclusion clause - this means it is still refundable under contract law - meaning, the money is held under trust but still belongs to the original buyer)

2. Few days later, he said he can't sell the safc to me as his current one was damaged. Since I had no choice to the matter, reluctantly said ok. He said he would refund.

3. Another day or two, he informed me again to say that he found a replacement unit and he can now sell the safc. However, as my car is still in the workshop, I said ok & will confirm taking once the car is ready.

4. However, my wiring problem took longer than expected & told him to sell it off first since he could get his money faster rather than waiting for me. Also, during the time of his 1st cancellation I had already booked another safc since I was told he could not sell it to me.

5. Once I saw his post that he sold off the safc, I asked for my money back. AFter all, the sale transaction did not complete and there was no exclusion clause as to non refundable deposit. I have a right to my money. The seller disagreed & said the deposit is forfeited.

Conclusion - I felt 8710 cheated my money both unethically & illegally. Taking someone's elses money tantamounts to theft.

Course of action - Since the seller does not want to return my money, the only thing I can do now is :-

1. report his actions to the forum so whenever anyone deals with him in the future, pls take note.
2. report to police - since I have his details and car no. I will proceed to make a police report for theft. Although it is only RM20, it doesn't give a person a right to steal. I hope a maximum sentence of 5 years inprisonment will be worth my RM20.

Advise - next time for any sellers/buyers pls make sure there is a written proof whenever money/product has been transacted to avoid things like this happening. If u feel that u have been cheated, make sure you report it not only to this forum but also to the proper authorities so that others will not suffer the same fate.
ok...here's your side of the story. Interested parties can refer 'For SALE & ADS' under 'Engine and Performance' topic...'ZTHians...Pls be judges...read last posting' for my side of the story... If u guys feel I that I'm in the wrong, I'll gladly return the money back to him... But pls hav a look to be fair!
